DIGITAL IMAGE LICENSE, CLIENT USAGE & TERMS OF SALE

1. CLIENT USAGE & DIGITAL IMAGE LICENSE

Captured By Alexus LLC (“Photographer”) grants the Client a non-exclusive, non-transferable, perpetual license to use delivered digital images for personal, non-commercial purposes, subject to the terms of this agreement.

The Client may download, print, reproduce, display, and share delivered images for personal use, including prints, enlargements, gifts for family and friends, personal websites, and personal social media accounts.

This license does not transfer copyright ownership to the Client. All images remain the intellectual property of Captured By Alexus LLC and are protected by applicable copyright laws.

Any commercial, promotional, or business-related use of the images requires prior written permission and a separate written licensing agreement with the Photographer.

2. SOCIAL MEDIA & SHARING

The Client may share delivered images on personal social media accounts, provided the images are not used for commercial purposes.

When sharing images, the Client is encouraged to credit Captured By Alexus LLC and tag @capturedbyalexusllc when possible.

The Client may share gallery links and use available social media sharing functions. The Client may not screenshot, screen-record, or otherwise capture images from the online gallery when downloadable files have been provided.

The Client agrees not to significantly crop, alter, apply filters to, or otherwise edit delivered images in a way that changes the Photographer’s original editing and artistic style.

The Client may not remove watermarks or copyright notices, if present.

3. PERMITTED USES

The Client is permitted to:

Download and store delivered digital images for personal use.

Print images for personal display, including prints, canvases, and other physical products.

Share images with family and friends.

Post images on personal social media accounts and personal websites.

Create personal photo albums, slideshows, and gifts.

Make reasonable copies for personal backup purposes.

4. PROHIBITED USES

Without prior written permission from Captured By Alexus LLC, the Client may not:

Sell, resell, sublicense, redistribute, or commercially license the images.

Use the images to promote a business, product, service, brand, or paid advertisement.

Submit images to contests, publications, or third-party platforms that require additional commercial rights or licensing.

Claim the images as their own work or misrepresent the Photographer’s authorship.

Remove copyright notices or watermarks, if present.

Significantly alter, edit, filter, or manipulate the images.

Use the images in connection with unlawful, defamatory, or otherwise prohibited content.

Incorporate the images into trademarks, logos, or service marks without express written permission.

Transfer or grant image usage rights to another person, business, or organization beyond the personal sharing permitted under this agreement.

Any commercial use, publication, or promotional use outside the permissions granted here requires a separate written agreement with the Photographer.

5. COPYRIGHT & OWNERSHIP

All photographs created and delivered by Captured By Alexus LLC remain the copyrighted property of the Photographer. Purchasing a photography session, digital gallery, or print does not transfer copyright ownership to the Client.

The Client receives only the usage rights expressly granted in this agreement. All rights not specifically granted to the Client remain with Captured By Alexus LLC.

The Photographer retains the right to use images for portfolio displays, website content, social media, advertising, and other business-related promotional materials, subject to any separate written agreement or applicable privacy, publicity, and consent requirements.

6. THIRD-PARTY LIABILITY

To the extent permitted by law, Captured By Alexus LLC is not responsible for claims, damages, or losses arising from the Client’s unauthorized use, distribution, alteration, or misuse of the images.

Nothing in this agreement excludes or limits liability where such exclusion or limitation is prohibited by law.

7. PRINT STORE TERMS OF SALE

Orders & Payment

All print orders must be paid in full at checkout. Orders will be processed after payment has been successfully received.

Customers are responsible for reviewing their selected images, print sizes, quantities, shipping information, and order details before completing checkout. Once an order has been submitted, changes or cancellations may not be possible if the order has already entered production.

Print Quality & Color Variations

All photographs are edited by Captured By Alexus LLC according to the Photographer’s artistic style. Printed colors, brightness, contrast, and overall appearance may vary slightly from the images displayed on a computer, tablet, or phone due to screen calibration, print materials, and printing processes.

Normal variations between screens and printed products are not considered printing defects.

Shipping & Delivery

Print products are fulfilled and shipped according to the policies and estimated production and delivery times of the applicable print lab.

Delivery estimates are not guaranteed and may be affected by production delays, shipping carrier delays, weather, or other circumstances outside the Photographer’s control.

Customers are responsible for providing a complete and accurate shipping address at checkout. Captured By Alexus LLC is not responsible for delivery issues caused by incorrect or incomplete addresses supplied by the customer.

Returns, Refunds & Damaged Products

Because print products may be made to order, all sales are generally final. Returns, exchanges, and refunds are not offered for changes of mind, incorrect product selections, or normal color variations between screens and printed products.

If an order arrives damaged, defective, or incorrect, the customer should contact Captured By Alexus LLC as soon as possible with their order details and clear photographs of the issue.

Reported issues will be reviewed, and appropriate next steps may include a replacement or refund, depending on the circumstances and applicable print lab policies.

Nothing in these terms limits any rights or remedies available to customers under applicable law.

Print Copyright & Reproduction

Purchasing a physical print does not transfer copyright ownership or grant permission to scan, copy, reproduce, resell, or commercially distribute the photograph.

Purchased prints are intended for personal display and enjoyment unless separate written permission has been granted by the Photographer.

8. CUSTOMER RESPONSIBILITY

Customers are responsible for checking their order details before completing a purchase, including image selection, product size, quantity, and shipping information.

If a problem occurs with an order, customers are encouraged to contact Captured By Alexus LLC so the issue can be reviewed.

9. ACCEPTANCE OF TERMS

By downloading, using, reproducing, or sharing delivered digital images, or by placing an order through the Captured By Alexus LLC print store, the Client or customer acknowledges that they have read, understood, and agreed to the applicable terms of this agreement.
